MEETING MINUTES
HOLDERNESS, NH 03245
DECEMBER 16, 2004

MEMBERS PRESENT:        Mr. Hanson, Mr. Waldrip, Ms. Scothorne, Mrs. Tuveson,
Mrs. Peoples, Ms. Webster, Mr. Sweeney

OTHERS PRESENT: Ms. Hancock – Recording Secretary for Board Works

CALL TO ORDER:          Mr. Hanson called the meeting to order at 6:55 p.m.

PUBLIC HEARING: Mr. Charles Burhman came before the Planning Board to   
Site Plan Review,               apply for a parking lot for 14 spaces for his property located
Charles Burhman                 at 23 South River Street to be utilized by his apartment tenants.
23 South River Street   He explained that the property abuts the college parking lot on
Map 225, Lot 14         Holderness Road and there is 51’ between the proposed parking lot and the front lawn of the residence.  The Board reviewed photographs provided of the property.  

Mr. Hansen voiced his concern with regard to any proposed signage and the applicant assured the Board that no signage was intended for the property.  Mr. Burhman emphasized that the additional parking would be for tenants use only.  

The Board and the applicant discussed the possible use of the parking area for employees at Palmison Graphics and for employees at a new cafe to open soon near the property.

                                Mr. Hansen called for public and abutters input, none was heard.  

                                It was moved by Mr. Hanson, seconded by Mr. Waldrip to accept the application as complete.                                      Vote was unanimous.  

It was moved by Mr. Hanson, seconded by Mrs. Tuveson to accept the site plan for 14 parking spaces subject to the following:

The grade of the property shall remain the same.
The elevation shall remain the same or could be lower.
No permeable surface shall be put on the parking area without coming back to the Planning Board.
The parking is for 14 spaces only and for use by the tenants at lots 13/14 and for employees of Palmison Graphics and the café to open soon

                                Vote was unanimous.

Boundary Line Adjustment        Mr. Devine came before the Board and explained that there are 3

(parcel 241.42 and 241.43)      Mr. Bemis (surveyor for Squam Lakes Association) was present and explained that the parties were before the Board this evening for a Boundary Line Adjustment.  He advised that the three properties are adjacent.  He stated that the left parcel on the site map presented belongs to the Squam Lakes Association, the middle parcel (241.42) belongs to the Squam Lakes Preservation Association, and the right parcel belongs to the Squam Lakes Association.  He explained that with the approval of the Boundary Adjustment the left parcel’s (SLA) acreage would go from 3.93 acres to 4.87 acres, the middle parcel (SPA) would increase to 1.89 acres, and the right parcel (SLA) would increase to  2.55 acres.  The Board was shown a map of the involved parcels, where the present boundary is and where the
                                proposed boundary adjustment would be.

Mrs. Tuveson expressed concern as to the location of the septic system for the existing building on the property.    Earl Hanson advised that the boundary adjustment met the 35’ setback requirement of the Town.  

                                Mr. Hansen called for public and abutters input, none was heard.  

It was moved by Mr. Hanson, seconded by Mrs. Tuveson to accept the Boundary Line Adjustment as presented subject to the following:  

That the applicants set pins to designate the boundary and that a mylar map of the property be given to the Planning Board

Vote was unanimous.

Harold and Joyce Webster        It was explained that in September of 2004, Harold and Joyce
Parcel #224, Lot 41     Webster bought a parcel of land on the corner of Mt. Prospect Road and Heritage Hill Road (this parcel was surveyed by D. Miller in 1965).  The original site map was approved by the Holderness Planning Board on Dec. 16, 1968.  The boundary line was approved in 1965 is so marked and is now in question.  In 1972, the Planning Board approved a plan for the Wild Rose Lane Subdivision adjacent to this property. In the 1972 approved plan, the boundary line from the 1968 approved plan has been redrawn.   The present Webster deed to the property matches the site map surveyed in 1965 and approved in 1968.  The Websters have been taxed for 36/100 of an acre (which is the discrepancy between the 1965 approved plan and the 1972 approved plan) for the past 32 years.

It was explained that the Websters are asking for a quick claim deed from the Town that gives them ownership of the 36/100th of an acre for which they have been taxed for 32 years.  They want their present deed to the property to reflect this change. The Websters have spoken to all abutters     who would be affected by the change and have researched all past deeds and claims to the property.

It was the opinion of the Board that the present property would need to be surveyed including the 36/100th of an acre.  The resulting map would need to be stamped by the surveyor. Bring that stamped map to the Board and they would sign it.  

Mr. Sweeney voiced his concern that the Board was possibly  offering legal counsel.  The Websters were advised by the Board to speak with an attorney to make sure that the new deed could be done. They were further advised to have the surveyor survey the land, draw the boundary line and certify it and stamp the resulting map and bring the deed to the Board for their signature.  Then have the deed recorded at the Registry of Deeds.

                                The deed will state that the 36/100th of an acre will be owned by
                                Harold and Joyce Webster as part of their deed until the property
                                is either subdivided or sold.
                                
A concern was raised about the Wild Rose Subdivision.  The Board assured the Websters that the surveying of that subdivision was done in two phases: one in 1972 and one in 1976 so there are site maps dated either 1972 or 1976.

                                The Websters will return to the Planning Board after they have
                                consulted an attorney, the survey has been complete and the
                                boundary certified.  The deed will be drawn up and the Board
                                at that time will sign it.
                                        
OLD BUSINESS            The Board was updated about the David and Denise Causette site
                                specific application.  The Board was informed that the application
                                has been submitted to the State and any public comment needs to
                                be heard by January 3, 2005.

The next meeting of the Holderness Planning Board will be Thursday, January 20, 2005. 7:00 p.m.

ADJOURNMENT     At 7:50 p.m., it was moved by Mr. Hansen, seconded by Mr. Waldrip that there being no further business to come before the Board that the meeting be adjourned.  Vote was unanimous.
