June 12, 2007
CALL TO ORDER Mr. Barbera called the meeting to order at 7:00 p.m.
MEMBERS PRESENT: Mr. Bass, Mr. Barbera, Mrs. Gyda Discosola, and Ms. Webster.
OTHERS PRESENT: Ms. CJ Spradlin, Mr. Benson Rudy, Mr. & Mrs. Earl Jenkins and Anne Abear
NEW BUSINESS: It was moved by Mr. Bass and seconded by Ms. Webster to accept and approve the minutes of the May 8, 2007 meeting as written. Vote was unanimous.
PUBLIC HEARING Mr. Barbera opened the public hearing at 7:05 pm.

Mr. Benson Rudy, General Manager for Walter's Basin Restaurant
Walter's Basin Rest. attended the meeting to present a proposal to add a deck to the side
Special Exception of the restaurant. Mr. Rudy advised the purpose of this deck will
101-025-000 be for the implementation of the NH smoking laws that are forthcoming in which smoking will not be allowed inside the restaurant. Mr. Rudy advised some of the cliental of the restaurant are smoking and this will accommodate them. If this deck is not approved and the NH smoking law takes effect, Mr. Rudy expects the patrons to stand out in front of the restaurant along the side walk. Mr. Rudy continued by stating he is also proposing gutters and a natural filtration system. The seating will be for 25 patrons on the deck. The proposal was to remove the 25 seats of waiting area at the front of the restaurant and place these seats on the deck area.
The Board discussed the boundary/property line. Mr. Rudy advised the entire building is within the setback. The deck would be on the property line. Mr. Rudy advised he spoke to and received good feed back from both of the side abutters.
Mr. Bass advised since this commercial property is within the setback requirements; the zoning ordinance requires approval of the Planning Board and the Health Officer to be approved as a special exception. Mr. Rudy was requested to contact Richard Mardin as Town Health Officer and Earl Hansen as Planning Board Chairman to get the required approvals.
Abutters, Mr. & Mrs. Earl Jenkins advised they were directly across the lake from the restaurant and were opposed to the zoning board allowing the request of the special exception as proposed by Walter's Basin Restaurant. He advised to allow for a special exception to skirt a NH law was not right and that he applied for a 2 foot exception some time ago and it was denied. Further, Mr. Jenkins requested the Board to consider the possibility of lighting and music.
Mr. Ivan Bass moved to continue the public hearing to July 10, 2007 for the purpose of allowing the applicant to acquire the necessary approvals from the Holderness Planning Board and the Holderness Health Officer as required by the Holderness Zoning Ordinance. Ms. Webster supported this motion. Vote was unanimous.
ADJOURNMENT At 7:35 p.m. it was moved by Ms. Webster, seconded by Mr. Bass that there being no further business to come before the Board that the meeting be adjourned. Vote was unanimous.
